Ortega-López is currently at the Dona Ana County Detention Center, where he is accused of being an illegal foreigner in possession of firearms.
It is not clear if Judge Cano or his wife, Nancy, will be accused of housing an illegal foreigner or providing material support to a foreign terrorist organization.
